Family of wonderful man receive compensation for mesothelioma death

James Simpson died from mesothelioma just before Christmas in 2009. His wife, Kathleen, continued his claim. Dushal Mehta recovered £121,716 damages in August 2010.

James was born in 1926. He worked at Deptford Power Station for almost 25 years and during this time he was exposed to asbestos as he had to knock off asbestos lagging to carry out repairs to the various joints and pipes at the power station. James was exposed to blue and white asbestos during his time at the power station.

The power station was very dirty and dusty and it was difficult to see from one end of the room to the other because of the dust. James was never provided with any respiratory masks or protective devices when working at the power station.

James took voluntary redundancy from Deptford Power Station in 1971 and went to work at the London Stock Exchange until his retirement in 1985.

James was diagnosed with mesothelioma in November 2009 and died six weeks later just before Christmas aged 83. He had expressed a wish to pursue a mesothelioma claim after his diagnosis.

Dushal Mehta had been instructed by James before his death and settled the claim for £121,716.

The case was funded on a "no win, no fee" basis and James' family received full amount of compensation.

At the end of the case James' son in law, Barry Swan, said:

"I wanted to express my sincere thanks for the professional service provided by Dushal Mehta. At such a difficult and emotional time, his approach was sensitive and caring.

"Dushal respected that we were grieving and ensured contact and input from us was kept at a minimum, yet he always kept us informed. It was my father-in-laws wish to make a claim but unfortunately he passed away within 6 weeks of his diagnosis.

"While no amount of money could ever compensate for the loss of such a wonderful man, we hope that an increase in claims will bring further awareness of this horrendous and preventable occupational disease"
