£4.5m settlement for 10-year-old struck by a train whilst a passenger in a car

Paul McNeil successfully acted for JXH in a road traffic accident claim.

JXH, aged 10, was travelling as a front seat passenger in a Jeep driven by his grandfather in July 2010. As the vehicle proceeded through an unmanned level crossing a train collided with the vehicle. JXH was ejected from the passenger window and suffered serious neurological injuries as a result of the accident. JXH suffered multiple fractures of the skull and extensive haemorrhagic contusions.

JXH, now aged 18, has made a remarkable physical recovery from the accident, but he sadly suffered severe cognitive impairment.

Following the accident, James found it difficult to understand and process information. He suffered from fatigue and became easily distractible. JXH suffered a substantial impairment of his memory function.

Paul McNeil was instructed in 2010 following the accident. He instructed a team of 11 experts to assess JXH and prepare reports.

Paul McNeil successfully settled the claim for £4.5million at a Round Table Meeting on 19 January 2018. The compensation ensures JXH has sufficient funds to undergo therapy, employ carers, and purchase a suitable home and various aids and equipment to help him achieve independence and enjoyment in life.
