Negligent treatment from Central Middlesex Hospital leaves client requiring orchidectomy

Mark Bowman was instructed by Oliver, aged 21 at the time, in a medical negligence claim against The North West London Hospitals NHS Trust.

On 28 July 2009 Oliver attended Central Middlesex Hospital and complained of acute right testicular pain. He had been advised by a family member to say that he was concerned he had suffered a testicular torsion. Arriving at 19:00 at Central Middlesex Hospital, Oliver was not seen by a junior doctor until 23:30. The junior doctor asked for assistance from a senior doctor, but in spite of Oliver asking if he had suffered from a testicular torsion he was diagnosed as suffering from an infection. Oliver was prescribed antibiotics and was told the hospital would call him the following morning to arrange an ultrasound scan.

Oliver returned home in pain and waited to be contacted by the hospital. He returned at 16:10 on 29 July 2009. The ultrasound scan unsurprisingly revealed a right testicular torsion and Oliver required the removal of his right testicle (a right orchidectomy) that evening. 

Despite the clear circumstances of the case, liability was finally admitted in March 2011. Efforts were then made to quantify the claim and a report was obtained from a urological surgeon to comment on the treatment options available to Oliver, which included a testicular prosthesis and sperm banking. In addition, a report was obtained from a psychiatric expert to comment on Oliver's emotional reaction to his substandard treatment. Oliver was diagnosed as suffering from both an adjustment and anxiety disorder.

Following negotiations with the Defendants, Fieldfisher were able to secure substantial compensation for Oliver in an out of court settlement.
