First Observatory on the case law of financial derivatives at renewable energy companies in Spain

JAUSAS has been producing case law statistics on complex financial products every year since 2012. This has allowed us to detect if there is a specific problem related to derivatives contracted by renewable energy companies that in the vast majority were financed under the Project Finance modality.

An increase of lawsuits is expected and it recommends that we carry out specific monitoring on the case law in the renewable energy sector and then produce the first edition of this “Observatory on the Case Law on Claims for Financial Derivatives in Renewable Energy Companies”.

The analysis that we provide on this Observatory will demonstrate that since the Supreme Court made their first two judgments at the end of 2015 there was a change in trend and each time larger sized companies or even professionals obtained favourable judgments.
