Legislative reform to reverse PACCAR ruling is suggested, but no timeline is set

The government has announced its intention to legislate to reverse the impact of the Supreme Court’s 2023 decision in PACCAR , which held that certain litigation funding agreements (LFAs) were unenforceable because they constituted Damages-Based Agreements (DBAs). This judgment created significant uncertainty for funders and claimants, disrupting the litigation funding market and raising concerns about access to justice.
