Compensation for road accident caused by husband

Mark Bowman recovered £34,000 compensation for Lori, who was injured in car crash while coming home from a birthday party with her husband, Albert.

Lori was at her son-in-law's 50th birthday party with her husband in January 2009. They left on Sunday evening with Albert driving Lori back to their home in Maidstone.

Albert lost control of the car and collided with another vehicle. Both Lori and Albert sustained injuries as a result.

Lori, who is 78, was previously a fit and healthy woman. She was taken to Maidstone Hospital where was treated for her severe injuries.

She suffered from a compound fracture (where the bone sticks through the skin) to her left tibia and fibula, a fracture to her right fibula and five broken ribs. She also sustained a head injury and required a CT scan which revealed a small bleed on the brain, but which thankfully did not require medical intervention.

Her injuries involved treatment at the hospital for over two months and she was wheelchair dependant on her release.

After another six weeks Lori was able to move about on a zimmer frame when indoors but it wasn't until the summer 2009 that she was able to return to any of the domestic duties at home.  

Mark Bowman received instructions from Lori to pursue a claim against her husband. Liability was admitted and we were able to secure an early interim payment to cover the expenses that Lori had incurred.

In order to quantify the claim and to confirm the nature and extent of the damage that Lori sustained, expert evidence was obtained from an orthopaedic surgeon.

Detailed witness statements were taken from Lori and her daughter, who had been her primary carer during her rehabilitation.

Following discussions with Albert's insurers we were able to achieve a settlement of £34,000 in compensation for Lori, which she was delighted to accept.
