Fieldfisher instructed by motorcyclist who lost his right leg

Clive was left critically injured following his involvement in a road traffic accident. The accident occurred while Clive was riding his motorcycle along the M11 on the London bound carriageway, when another motor vehicle slowed/stopped suddenly in front of him causing an accident involving our client. Unfortunately, the driver did not stop and the police have not been able to trace him/her.

Clive suffered life threatening injuries as a result of the accident. He had multiple organ failure and sustained an open fracture of his right tibia and fibula. Efforts were made to save Clive’s right leg, but unfortunately he developed an infection and so underwent an above knee amputation.

Fieldfisher were instructed to pursue Clive’s personal injury claim. As the Defendant driver could not be traced, the claim is being pursued in accordance with the relevant Untraced Drivers’ Agreement against the MIB.

Liability was agreed swiftly after Fieldfisher became involved and the required evidence is now being gathered so that Clive’s claim can be valued. 

There is a common misunderstanding that if a driver cannot be traced or does not have insurance a claim cannot be progressed. This is not the case. The MIB is a government-run organisation to which all road traffic insurers must contribute. The MIB compensate people following accidents in these scenarios when they would otherwise be left without treatment and rehabilitation.
