Clive suffered life threatening injuries as a result of the accident. He had multiple organ failure and sustained an open fracture of his right tibia and fibula. Efforts were made to save Clive’s right leg, but unfortunately he developed an infection and so underwent an above knee amputation.
Fieldfisher were instructed to pursue Clive’s personal injury claim. As the Defendant driver could not be traced, the claim is being pursued in accordance with the relevant Untraced Drivers’ Agreement against the MIB.
Liability was agreed swiftly after Fieldfisher became involved and the required evidence is now being gathered so that Clive’s claim can be valued.
There is a common misunderstanding that if a driver cannot be traced or does not have insurance a claim cannot be progressed. This is not the case. The MIB is a government-run organisation to which all road traffic insurers must contribute.
