Security over land

Lending secured on land remains an important part of their business for many lenders, whether they are providing commercial, investment or development finance, or lending to homebuyers. This briefing paper provides an overview of taking security over land in England and Wales. It is not intended to be comprehensive, and the focus is on commercial and investment property. For the sake of convenience, we refer to the person giving the security (the mortgagor or chargor) as the “borrower” and the person taking it (the mortgagee or chargee) as the “lender”. The term “land” is used rather than a more technical legal term such as “real property”. It is assumed that title to the land is registered.
