Successful claim for woman devastated by loss of husband in fatal cycling collision

Claire was instructed by the wife of a 37-year-old man who was fatally injured while cycling to work in London. Jane's husband cycled regularly with friends for pleasure and on his daily commute to and from work. He knew the road well and was an experienced cyclist in the heavy London traffic.

As he negotiated a roundabout, a large goods vehicle turned left without indicating and collided with him. From the cyclist's perspective, there was no sign that the lorry was about to turn. The injuries he sustained in the collision were fatal. The driver of the lorry was later convicted at trial of causing death by careless driving.
 
Jane and her husband met at university and were married without children. Her husband was the main bread-winner, working in a job that he was passionate about. The couple enjoyed travelling together and all of the cultural opportunities that London has to offer. Jane was absolutely devastated by the loss of her husband, companion and best friend.
 
Claire worked closely with Jane, sensitive to the huge emotional impact that the loss had had on her. Her husband's death had also had a huge financial impact on Jane's future. On a practical front, the loss had disrupted a planned house move, but the loss of financial security was also a worry, and meant that it would be more difficult for Jane to retrain and pursue a different career.
 
Claire obtained witness evidence from Jane's husband's colleagues and a recruitment consultant who knew him and the field he worked in well. The witness evidence proved what a capable, motivated and ambitious employee he had been, as well as a kind and trusted colleague who was well liked and whose loss was keenly felt. Claire went on to obtain reports from an employment expert and a forensic accountant to establish what financial loss Jane had sustained.
 
Claire negotiated a significant, six-figure final settlement with the defendant driver's insurer, which has given Jane financial security for the future and will allow her to move forward with her life without many of the practical and financial worries that the loss had caused.
 
Following settlement, Jane said: 'Thank you so much from the bottom of my heart to you and the team at Fieldfisher, but mostly to you for taking me through something I wish I never have to go through ever again. I feel very, very lucky to have had you to look after me. ... no words can express my gratitude'
