Permanent disability and depression following negligent foot surgery
In October 2005, Alison, a journalist, underwent a bunionectomy and basal osteotomy on the first right metatarsal. She also had a screw that had been used to fix a fracture on her right foot almost two years previously removed from the fifth metatarsal.
During the operation the surgeon removed an excessive amount of her toe and she has since undergone further surgery and treatment.
She continues to have pain in her right foot. Her mobility is affected – she needs crutches to walk and suffers from shoulder and neck pain as a result.
Alison worked as a sub-editor for a national newspaper but has been unable to work from the office because of her injuries. She suffered financially as a result of losing her job and also suffered psychiatric injuries as a result of the negligent surgery. Alison also previously carried out a lot of DIY work, which she can no longer do.
We were instructed to pursue a claim for medical negligence against the surgeon who carried out the foot surgery.
The defendant admitted his errors and that it caused Alison to suffer pain and consequent deformity along with the need to undergo additional procedures and treatment.
He made three interim payments which allowed Alison to complete renovations on her house which she was unable to do herself because of her injuries.
The defendant agreed to settle the claim and paid Alison £650,000 damages, which Alison was happy to accept.
