EU: The Whistleblowing Directive - Transposition delays and challenges: How should multinational businesses respond?

Nick Thorpe and Richard Branson, Partner and Senior Associate respectively at Fieldfisher have written an article which explores the challenges that have arisen from the transposition of the EU Whistleblowing Directive, officially titled 'the Directive on the Protection of Persons who Report Breaches of Union Law (Directive (EU) 2019/1937)'.

The EU passed the Whistleblowing Directive on 16th December 2019 and gave a two year deadline for EU Member States to transpose the provisions into National Law. Many jurisdictions failed to meet the 17th December 2021 deadline, and even in April this year, only 8 or 27 member states have adopted new whistleblowing legislation.
