Jelena specialises in resolution of disputes in a number of sectors including construction, engineering and mining.  Jelena has experience of advising clients in both court and arbitration proceedings.

Jelena's experience includes:

  • Acting for a Balkan energy company (a Contractor on the project in question), in an international arbitration concerning a project for construction and extension of power substations and stringing of transmission lines between the substations which were located in two neighbouring countries.  The project was worth over €40m and it was based upon FIDIC EPC/T contract and the dispute was governed by the ICC rules.  The team successfully defended a jurisdictional challenge and won their application for a Final Partial Award against the Employer for €6.8m thereby securing the full amount of the sum awarded by the Dispute Adjudication Board.
  • Representing a publicly listed Spanish mining company in a claim for breach of the terms of the contract with a value over €50m.  The dispute arose in the context of the actions/steps taken by the mining company to secure finance in order to obtain the necessary mining permits to enable the company to start commercial production.  The claim centres on the interpretation of a number of key contractual provisions and definitions, and issues of good faith.
  • Acting for an international oil and gas exploration and production company in securing an interim injunction to prevent one of their former senior board members from continuing with his role as the president of a rival company and prevent him from revealing confidential information.
  • Advising on the terms and conditions of a major international company that provides equipment, systems and maintenance for air conditioning, filtering and cooling.

Jelena co-authored an article published in the May 2016 issue of the Building magazine entitled "Pay now, argue later".
