I am a patent litigator with particular expertise in biotechnology patents and have over 20 years' experience advising international companies in multi-jurisdictional disputes.
As well as acting in all UK courts, I advise on international disputes and coordinate and assist with actions in other jurisdictions and patent offices. My patent career began with the land mark case of Biogen against Medeva (the first case involving a biotechnology patent to be considered by the House of Lords) and to celebrate the 20th anniversary I chaired a reunion of the people involved. Since that case I have acted in many significant cases, in particular, in the life sciences sector. One of my key clients throughout that time has been GSK and its predecessor companies.
My experience has involved complex cases involving complex science and a number of jurisdictions. One of my key skills is to manage and coordinate the many scientists and lawyers involved as well as keeping the client informed and confident.
Directory quotes include:
"Diana Sternfeld of Fieldfisher is a highly experienced patent litigator whose recent activity includes advising on the co-ordination of a multi-jurisdictional dispute concerning innovative vaccine products. A client praises her "unfailing calmness and politeness, matched with a shrewd rigour and a technically and legally adept mind," which makes for "an unusual and highly effective combination.""
"Diana Sternfeld is described by a client as an "incredibly hard-working and knowledgeable" litigator who "has a supreme knack for putting together a great team and managing them to get the best out of everyone involved." She focuses on representing biotechnology companies in complex patent litigation." Chambers UK 2018.
Whilst I have acted on cases covering diverse technologies (including flooboards and on-line purchasing), my main area of expertise is in the biotechnology sector.
I am an active participant in the BioIndustry Association and have been a Member of the Board since 2011.
My first patent case of Biogen against Medeva was heard by the House of Lords and set the standard for sufficiency in patent cases for many years. It raised my client's, Medeva's, profile in the biotechnology sector. My most recent case led to a worldwide settlement which has allowed my client to continue to market its life saving vaccine.
I am an Associate Member of the Chartered Institute of Patent Attorneys and an accredited mediator.
