Nick Rose, Partner, IP and Technology, Protection and Enforcement, Fieldfisher

I am the head of the firm's intellectual property and technology litigation group.

I specialise in the enforcement of intellectual property rights with a particular focus on copyright matters (both artistic and technical copyrights), design law, trade marks, passing off and trade secrets.  I have represented many UK and international businesses in a wide range of IP litigation for nearly 30 years, in the High Court, Court of Appeal, Supreme Court and before the European Commission. I focus on the media and entertainment, technology, retail and sports sectors.

In the last decade I have been involved in many of the leading IP reported cases, which have included leading decisions on subsistence of copyright in still photographs, what constitutes use of a trade mark on the internet in different jurisdictions, the leading case on subsistence of copyright in user interfaces, screens, data structures and databases, reverse passing off, infringement of registered design rights relating to the design of a firefighter's helmet, and the misuse of technical trade secrets in the UK's largest ever confidential information case.

I have particular expertise representing clients enforcing their rights in famous fictional characters, and in a wide range of emblems and other materials in the sports sector, in respect of unauthorised merchandise being sold both online and at retail outlets.

I have written many publications and I am the author of "Pre-Emptive Remedies in Europe" (1992, Longmans) and am on the Panel of Contributors for "World Trade Mark Report" and "World Media Law Report".

I am consistently listed as a leading IP lawyer in the UK in the Legal 500 and Chambers Directories and the Legal 500 has described me as "one of the best for litigation".  I have also been rated as a leading expert in Chambers Global 2018 and as an outstanding lawyer for intellectual property in the UK in Super Lawyers which rates lawyers for more than 70 practice areas.

Chambers UK 2015 says I am "very popular with his clients, driven by their commercial interests above all else".

Most recently I have been recommended in the 2018 Chambers UK with the following feedback; "Nick Rose fosters "very good relationships with clients" and is "first-class on the commercial aspects" of complex IP litigation, according to sources. His recent activity includes a range of trade mark, copyright, database right and misuse of trade secrets disputes.

Who's Who Legal says Nick Rose is "an excellent litigator who is very effective and popular with clients", whom he regularly represents in UK courts and before the European Commission.
