James Medhurst, Senior Associate, Employment, Fieldfisher

I am a senior associate in the employment team in Fieldfisher's Birmingham office.

I specialise in Employment Tribunal litigation, as well as the TUPE aspects of outsourcing, corporate mergers and acquisitions, the sale of property, and public procurement.

I have appeared as an advocate in two reported cases about TUPE in the public sector, Tapere v South London & Maudsley NHS Trust [2009] IRLR 972, concerning healthcare, and Abellio London v Musse [2012] IRLR 360, concerning the tendering of contracts for bus services.

My experience also includes outsourcing in the media sector, employment issues arising from the sale of pubs and hotels, and the effect of TUPE on collective agreements in the rail industry.

I have successfully defended numerous employers, such as banks, retail outlets and food chains, against claims of unfair dismissal for misconduct. These cases require a detailed understanding of the day-to-day operations of the businesses, including cash handling and other security procedures, stock control, and food safety policies.

I have often advised where disciplinary action has been taken against employees and there have been overlapping regulatory considerations, such as when there has been a serious breach of financial services regulation or the Ofcom Broadcasting Code.

I have recently co-presented a seminar on the rapidly evolving case law for TUPE and I am a regular contributor to the Daniel Barnett newsletter, an e-mail service which provides updates on developments in employment law to more than 28,000 people.

I follow most sports, especially football, cycling, athletics, tennis and the Olympic Games. I also enjoy quizzes and playing card games, from poker to bridge.
