David Kaluwahandi, Solicitor, Dispute Resolution

David Kaluwahandi, Solicitor, Dispute Resolution, Fieldfisher

I am a solicitor in the Dispute Resolution department.

I specialise in commercial litigation, arbitration, shareholder disputes and general commercial disputes though am able to advise on all forms of alternative dispute resolution.

I have strong commercial awareness which enables me to identify key issues quickly and offer practical advice to clients.

I am an effective and confident communicator with a calm temperament.

I am efficient in locating, understanding and applying legal concepts to factual circumstances.

I have worked pre-dominantly in IT & IP related disputes though I also have experience working in the financial services, transportation and clothing & retail sectors.

I worked on defending a claim brought against a client for alleged breach of contract. The claimant alleged that the client had permitted unauthorised access to the claimant's ERP system to its employees and customers. The issue of liability was decided upon in the High Court before both parties applied for permission to appeal to the Court of Appeal. The issues in dispute were of critical importance to the provision of software products by suppliers to their business customers worldwide. Initially, I worked closely with the client in attempting to quantify its liability and interpret relevant documents. I also worked on compiling the documents to be submitted as part of the successful application to the Court of Appeal.

When working with a global banking client in defending proceedings brought by one of its commercial clients, who alleged negligence and a breach of fiduciary duties, I reviewed and reported on a number of lengthy investment documents within a short space of time. This enabled detailed advice outlining the client's position and defence options to be provided in advance of the client's expectations. I also managed the early litigation proceedings by contacting and evaluating potential expert witnesses and by liaising with the court.

When advising a leading European food intolerance and allergy testing company in respect of its efforts to develop a food allergy mobile application with a software platform developer, I formulated and implemented a strategy that avoided the threat of an injunction being made against the client and limited the liability and exposure of the client under the collaboration agreement.

Resolved and prevented a claim being issued against a client, a leading ventilation company after it was alleged that it had supplied the incorrect models which had caused loss to one of its clients. I successfully argued that the client had actually fulfilled its contractual obligations, thereby avoiding proceedings being issued against them.

I regularly present and report on case law updates to clients.

My highlights include:

  • I have advised one the largest technology companies in the world on the competition implications of its agreements with e-book publishers in Asia.
  • Advised a security company on a series of commercial contracts for the provision of armed guards to accompany ships transporting goods through the Indian Ocean.
  • Worked with a leading manufacturer of aviation parts to settle commercial disputes with a series of suppliers.
  • Advised a leading European agricultural and food processing cooperative group in defending a statutory demand issued against it. I continue to work alongside the business advising on contractual disputes with its clients and suppliers.

I am a sports enthusiast and a Chelsea season ticket holder. I also enjoy reading historical books and travelling.
