Emma Capper, Partner, Employment
I advise clients on all aspects of employment law, across a variety of business sectors.
I have particular expertise in relation to international issues such as advising on the assignment of employees abroad and assisting clients with cross-border projects, for example implementing new terms and conditions of employment, or establishing the legality of new policies across multiple jurisdictions. I co-ordinate advisers across a range of jurisdictions where clients need to implement an overall strategy on global employment issues.
In addition, I support the Corporate and Technology, Outsourcing & Privacy Teams on the employment aspects of transactions, ranging from share sales to business transfers. This often also involves negotiating terms for senior executives who will be remaining with the business post-completion. In addition I advise on TUPE transfers in the context of business transfers and commercial outsourcing projects.
I regularly present at the Team’s public seminars and carry out client training on a wide range of topics.
I was recommended for advice on international assignments in Legal 500 2015 and was a recommended lawyer in Legal 500 2016.
Recent projects that I have worked on include:-
Assisting a multinational events and publications business on the implementation of new contracts of employment across 16 jurisdictions. This involved liaising with lawyers in each jurisdiction to establish fee proposals and co-ordinate amended contracts for the client.
Assisting a global software security company on the employment aspects of an asset acquisition, involving employees across 8 jurisdictions (UK, Czech Republic, France, Germany, Italy, Switzerland, Russia and the UAE).
Advising a global laboratory supplier on the employment aspects of an outsourcing agreement to provide lab services, negotiating the services agreement and advising the client on changing terms and conditions of employment post-transfer.
