No hazard warning: Samsung wins with Fieldfisher
Samsung’s internet-capable television sets do not have to carry a "hazard warning" that informs the customer before purchase, that personal data can be collected after the device is connected to the internet. This was decided by the Higher Regional Court of Frankfurt on October 5,2017 (Case No. 6 U 141/16) in an appeal procedure and thus overturned the decision of the lower instance. The consumer association had filed a complaint against Samsung Electronics GmbH.
The process was closely followed by the consumer electronics industry, with potentially wide-ranging issues threatening to affect almost all manufacturers of internet-enabled devices. Fears were voiced that there would be a "signposting forest" in the retail sector and that information requirements would be extended in accordance with US models.
