Fieldfisher is delighted to inform you that we
will be hosting the first Intellectual Property breakfast briefing of our 2015
programme at our riverside offices at Riverbank House on Tuesday 20 January 2015 from 8.30 to

breakfast briefings will cover significant
legal developments and cases in relation to all areas of IP
, as
well as refreshers and discussions on topics of
interest, with a focus on the practical implications. The first briefing aims to
tackle the thorny issue of groundless threats. The breakfast briefing will be
delivered by Lucy Nunn, Director and Tommy McKenna, Associate both
of our IP and Technology Protection and Enforcement team.

Rights owners have long been subject to potential
liability for making unjustified threats in relation to infringement of patents,
trade marks and design rights. The often misunderstood UK threats regime has
received a great deal of criticism over the years, and was the subject of a Law
Commission review in 2014.  However although recommendations for reform were
made, we are still awaiting the Government's final response to the
recommendations and any formal plans for reform. Anyone considering enforcing
their IP should have a clear understanding of the implications of the current
regime for them to avoid inadvertently falling foul.

Fieldfisher advised
Best Buy in one of the most significant trade mark threats cases in recent years
– to which an entire chapter of the Law Commission's report was dedicated – and
in this briefing we will explain the scope of the rules, their practical effect
and the implications for your enforcement strategy in the UK and elsewhere in
Europe. We will also explore the Law Commission's proposals for reform.
