will be speaking at our PRG Seminar on Tuesday 11 March 2014 at 5.30pm.

The session will cover the possible increase in powers of criminal sanction over healthcare and other professionals and the issues that this may give rise to for regulators.  There will be practical guidance on how to manage a regulatory investigation when there are concurrent criminal investigations.  It will cover recommendations made in the Francis Report and recent statements by the Health Secretary about a new offence of wilful neglect.

The speakers will also look at the decision of the Court of Appeal in R (on the application of A) v Chief Constable of Kent EWCA Civ 1706 , which concerns the balance between the need for disclosure of criminal convictions and a registrant's article 8 ECHR rights, as well as the powers of the judicial review court.  It will also look at the risks posed to regulators.
