Budget announcements on statutory residence test and ordinary residence

The Government has confirmed in today's Budget that, as originally announced in Budget 2011, a new statutory residence test will be introduced by Finance Act 2013 to take effect from 5 April 2013 with The Government has confirmed in today's Budget that, as originally announced in Budget 2011, a new statutory residence test will be introduced by Finance Act 2013 to take effect from 5 April 2013 with reforms to the concept of ordinary residence.

We anticipate that the new statutory residence test will be enacted largely in the form described in our recent briefing paper.

The Government has announced that the amended draft legislation will contain amendments to the concepts of full time work, international transportation workers and, as expected, to split year status.  When the revised legislation is published later this month we will update our briefing on the new statutory residence test.

With regard to ordinary residence, the Government has confirmed that following consultation the Finance Bill will contain amendments to the transitional rules for claiming overseas workday relief so that these will be aligned better to the present position.
