Update – SKYPE trade mark left grounded by General Court

Earlier this year we reported on the General Court's decision to refuse registration of the word SKYPE and the SKYPE logo as Community trade marks.  The marks had been opposed by Sky plc and Sky IP Earlier this year we reported on the General Court's decision to refuse registration of the word SKYPE and the SKYPE logo as Community trade marks.  The marks had been opposed by Sky plc and Sky IP International Ltd.

We can now confirm that Skype has appealed the General Court's decisions to the Court of Justice of the European Union.  It is claimed that the General Court made several errors in concluding that there is a likelihood of confusion and erred when considering the similarity of goods and services. We look forward to hearing what the CJEU has to say on the matter.
