White Collar Crime & Investigations
I have expertise in white-collar crime and have represented businesses and directors/senior managers subject to investigation and prosecution from agencies such as the Serious Fraud Office (SFO), Crown Prosecution Service (CPS) and Her Majesty's Revenue and Customs (HMRC) for wide-ranging offences including fraud, bribery and corruption and tax evasion.
I have undertaken internal investigations on behalf of corporates after they have discovered wrongdoing in their business or where they have been the victim of crime. For the latter category of clients, I have advised clients on possible criminal recourse including bringing a private prosecution under the Prosecution of Offences Act 1985.
I have also worked with witnesses in a number of high profile criminal investigations and facilitated compliance with production orders, s.62 SOCPA notices and disclosure orders for clients subject to these orders.
Recent representative examples include:
- Represented senior government officials in a Serious Fraud Office investigation into fraudulent activity in the operation of supplier contracts.
- Representing a director of a business in a long running and substantial multi-million pound tax evasion case which was investigated by HMRC and prosecuted by the CPS.
- Undertaking an investigation for a leading financial services company following allegations of fraud, bribery and corruption by a whistleblower.
- Undertaking an investigation for a leading retail business following a large scale fraud.
In addition to my WCC expertise, I have also advised and represented clients in a wide range of criminal cases including in connection with serious criminal offences, traffic offences and offences of harassment and stalking.
I am a Solicitor-Advocate with rights of audience in the Higher Criminal Courts including the Crown Court and Court of Appeal (Criminal Division).
Health and Safety
I specialise in Health and Safety matters and regularly advise companies relating to their health and safety obligations. I primarily focus on the construction, energy and transport sectors but receive instructions from clients in all sectors.
I have advised companies subject to investigation by the Health and Safety Executive and other regulatory authorities and have conducted internal investigations for companies following health and safety incidents.
I co-lead the Fieldfisher Health and Safety Covid response and since the announcement of lockdown and subsequent transition periods, I have been busy advising businesses in relation to their obligations concerning risk assessments, social distancing, working from home policies and increased hygiene provisions.
I regularly publish articles in relation to health and safety compliance and I am a member of the Health and Safety Lawyers Association (HSLA).
I am a key member of the Road Transport Regulatory Group at Fieldfisher and have advised and represented a number of operators of freight and passenger transport services at Public Inquiries and Preliminary Hearings before the Traffic Commissioner in relation to concerns with their operations.
I have represented operators at the Upper (Transport) Tribunal who wish to appeal a Traffic Commissioner decision.
In addition, I have advised freight parties in relation to their obligations concerning the Convention on the Contract for the International Carriage of Goods by Road (CMR) and the e-CMR.
In the commercial litigation sphere, I have acted for clients in a range of high value contractual disputes, shareholder disputes and cases involving fraudulent conduct.
In recent years, I have developed particular expertise in advising companies and individuals who wish to enforce or contest employment related restrictive covenants and covenants relating to confidential information, which often involves emergency injunctive relief.
