Fieldfisher secures important victory for Wolters Kluwer in Italian agency dispute

The European law firm’s Turin office successfully defended the provider of professional services information in Italy on a litigation matter with a local partner.

 
Fieldfisher has secured an important victory for information services company, Wolters Kluwer.
 
Wolters Kluwer is the leading global provider of professional information, software solutions and services for clinicians, accountants, lawyers, and tax, finance, audit, risk, compliance, and the regulatory sector, and are the publishers of the highly respected Kluwer Arbitration Blog.
 
In Italy, the company is the provider of expert solutions for professionals and companies including One Legale, Suite Next, Genya.
 
In 2016, the Italian branch of the company was faced with a claim from a former agent, who alleged that their agency contract was unlawfully terminated.
 
The former agent filed a claim before the Labour Court of Rome for approximately €1.5 million, seeking payment for loss of income, indemnity payments, commissions and compensatory damages.
 
The Italian division of Wolters Kluwer appointed Fieldfisher lawyer Marco Durante, who is a partner at the firm's office in Turin and who specialises in agency, distribution and franchise law.
 
Marco and his team assisted with the court case and, after two hearings which included oral submissions, in May 2018 the lower Court of Rome rejected the claim on all counts. The court accepted and agreed with all the arguments advanced in defence of the claim.
 
However, the claimant appealed the decision to the Court of Appeal in Rome. On 2 December 2020, the Court of Appeal of Roma affirmed the lower court's decision and dismissed the appeal and awarded a costs judgment in favour of Wolters Kluwer Italia.
 
The full judgment is due to be published in early 2021.
