Future immunotherapy costs included in settlement for dancer and cabinetmaker

Christopher had a lively career as a dance teacher, which he thoroughly enjoyed. He’d previously worked as an apprentice cabinetmaker for six years with the Cooperative Wholesale Society to give himself the financial security to continue enjoying and teaching dance. 

Unfortunately, Christopher was exposed to asbestos in the large open-plan premises of the Society, where asbestos board was cut in the machine shop. The defendants admitted liability early in Christopher’s claim and provided him with interim payment. This allowed negotiations to begin early.

Because Christopher has a very slow-growing mesothelioma, our medical evidence identified that he would be suitable for immunotherapy, a relatively new treatment, not available on the NHS but which has helped others in the treatment of their cancer.

Immunotherapy consists of several cycles and the cost depends on the duration of treatment and can amount to up to £250,000. It was therefore essential to negotiate a settlement to include future treatment for Christopher where beneficial. Fortunately, the defendants readily agreed to this and the settlement includes terms that funds will be available to pay for immunotherapy treatment as the need arises.
