Child awarded damages following road traffic accident

We pursued a road traffic accident claim for Stephen who was knocked down on his way to school. Although Stephen was partly to blame for the accident we negotiated a settlement of £100,000 after another solicitor said the claim would not succeed.

Stephen was nine years old when he was knocked over by a van on his way to school. He suffered a severe head injury and other orthopaedic injuries.

The driver of the van said that there was nothing that he could have done to avoid hitting Stephen. This was because Stephen had run out in front of the van. There were other witnesses who confirmed that Stephen had ran into the road in the path of the oncoming van.

Stephen's parents instructed another firm of solicitors to investigate a compensation claim but the other firm's lawyers and barristers advised that there would be little chance of success if they brought a claim against the driver for personal injury.

Unhappy with this advice, Stephen's parents approached our personal injury team to investigate the claim.

Our investigations indicated that there was a possibility of obtaining compensation for Stephen. Once we had issued proceedings we were able to negotiate a settlement of £100,000 which Stephen was happy to accept.
