Indian Trade Mark Registry held accountable for missing files
In line with the directions issued by the Honourable Delhi High Court, the Trade Mark Office issued a Public Notice on 25 April 2011 informing that a total of 44404 files relating to registered trade marks are missing from the five branches of the Trade Marks Registry, namely, Mumbai, Delhi, Kolkata, Ahmedabad and Chennai.
The Honourable High Court’s order comes as a relief to various petitioners who have been trying to trace their files at the various Trade Mark Offices. In order to reconstitute these files, the Trade Marks Registry has requested owners and representatives of all the missing trade mark registrations to furnish self attested copies of the documents available with them such as trade mark application forms, additional representations, examination reports, acceptance orders, registration certificates, documents relating to assignment/transmission of ownership, changes in name and address of applicants etc before 31 July 2011 at the appropriate branch. The documents provided will then be stored in electronic form.
