JxMx v Dartford & Gravesham NHS Trust wins Outstanding Case of the Year at the annual Eclipse Proclaim Personal Injury Awards 2015!
The team acting for the Claimant in this landmark case won the prestigious award for their work in securing anonymity for Claimants as routine practice in a Court of Appeal judgment handed down in February 2015. The announcement was made last night at an awards ceremony held at The Grange Hotel in St Pauls.
At the awards, it was noted that due to the large number of high calibre nominations received, the panel of judges were faced with many tough decisions to make when whittling down all the entries. However, it was clear that the case was a worthy winner, not least in setting a new precedent to allow Claimants to purse cases without having to worry about press intrusion at the end of their case..
Mark Bowman, partner in Fieldfisher's medical negligence team, represented JxMx with counsel Lizanne Gumbel QC and Henry Witcomb, all acted on a pro bono basis.
After the awards, Mark commented:
"We are very pleased that the law has been clarified as a result of our appeal. It is a fantastic achievement which allows Claimants security to pursue their cases, whilst also allowing cases in the public interest to be reported. It is great to have been recognized at the awards and to have won Outstanding Case of the Year!"
His medical negligence practice is wide ranging and includes birth injury, surgical negligence and delayed diagnosis amongst others. His personal injury speciality is catastrophic injury cases, sporting accidents and in particular road traffic accidents and accidents at work.
