James Flynn, Partner, Engineering, Projects & Construction
I have specialised in construction law since my qualification in 2000 and now have a broad practice covering both contentious and non contentious matters for subcontractors, contractors, developers, local authorities, investors and banks.
I am experienced in the drafting and negotiation of all types of construction agreements, from standard form construction contracts (including JCT, NEC, ICE, IChemE and FIDIC based forms) to consultants’ appointments, surety documents and development agreements. I have particular focus on student accommodation, hotel and leisure, residential and renewable energy projects, and has recently helped to secure funding streams for several clients in these sectors. I have advised on jobs from major mixed use development and regeneration schemes to large scale energy projects and very much in between.
On the contentious side, I handle litigation, arbitrations, mediations, adjudications and expert determinations for a wide range of clients ranging from major city councils to specialist local subcontractors. Recently, I have been involved in a number of successful adjudication enforcement actions and have developed a quick and effective way to enforce awards on behalf of my clients. I can adapt to provide a service ranging from “light touch” behind the scenes strategic advice to the (metaphorical) sledgehammer (although a literal one could be provided, for the right price).
