Failure to warn about specific disabilities
Pregnancy and childbirth are supposed to be very happy occasions in our lives. But sometimes parents have not been warned that a child will be born with a specific genetic disability. In some instances if they had been warned they would have terminated the pregnancy.
There are many different conditions that a baby can be born with including:
- spina bifida
- club feet
- holes in the heart
- Down's syndrome.
Failure to Diagnose
If your doctor or midwife fails to diagnose a birth defect which should have been easy to diagnose (perhaps due to a faulty scanning machine or lack of staff training) then you may be able to make a medical negligence claim for wrongful birth. In situations like this, damages often provide for the additional costs associated with caring for a child who has been born with a debilitating condition.
