Notable deals / highlights
Advised an international IT services provider as it competed for a number of high profile IT outsourcing projects and service deals. We led on providing multi-jurisdictional employment advice and support in relation to the potential transfer of staff covering both the UK and a significant number of separate jurisdictions (obtaining advice from local partners where appropriate).
Acted for a global organisation on a range of issues, including an anti-bribery and corruption investigation in the Middle East, advised on consequent Employment Tribunal claims in the UK and dealt with jurisdictional issues under the Employment Rights Act 1996 and the Equality Act 2010. To date, we have been successful in resisting all claims before the UK Employment Tribunal on territorial grounds, against the current direction of travel in respect of case law in this area.
Represented a major public body on a multi-day, multi-issue race discrimination dispute listed in the Employment Tribunal for eight weeks. The case tested our project management skills, was highly newsworthy and political in nature and involved issues going back over a decade, considerable documentation and numerous respondents and witnesses. The dispute was successfully resolved through an all-parties mediation that we led and coordinated.
Advised a City financial institution on an outsourcing deal with a mutual insurer whereby the management of £8bn of assets was transferred to our client. The work involved consideration of collective redundancy issues and TUPE. Some employees took voluntary exit packages pre-transfer, others objected to the transfer and were retained and a further group was transferred. A range of complicated settlement agreements were negotiated in addition to detailed provisions in the implementation agreement sharing liabilities through a series of indemnities.
Advised a Royal Academy in relation to a number of cross-border issues, including discrimination, constitutional and other matters and advising and supporting them in relation to malpractice / disciplinary action in South Africa and China by registered individuals.
