Notable deals / highlights

  • Acting for the Swiss liquidators of Lehman Brothers Finance S.A. in numerous derivatives related disputes ranging in value from a few tens of millions of dollars to over a billion dollars. Cases include In the Matter of Lehman Brothers International (Europe) (in Administration) [2013] EWCA Civ 188, which is the leading authority on the valuation principles to be employed in 2002 ISDA Master Agreement wording.

  • Acting for a European bank in a substantial claim the following the close-out of repo financing to a Euro 5 billion fund.

  • Acting for a Kazak entity in relation to substantial claims in arbitration arising out of a credit contingent swap designed to hedge exchange and interest rate risk on an EMTN Note programme.

  • Advising a major German bank in proceedings relating to service of credit event notices under credit default swaps linked to structured notes.

  • Advising an SPV invested in CDO transactions in relation to the manipulation of portfolio assets.

  • Advising a German investment bank on a USD500MN OTC derivative dispute as to collateral to be posted on an insurance linked ABS.
