Second Edition of the Observatory on the case law of financial derivatives at renewable energy companies in Spain

Fieldfisher JAUSAS has been producing case law statistics on complex financial products every year since 2012. This has allowed us to detect specific problems related to derivatives contracted by renewable energy companies that -in the vast majority- were financed under the Project Finance modality.

That’s why in 2018 we decided to create a specific monitoring of the case law in the renewable energy sector and we published the First Edition of the “Observatory on the Case Law on Claims for Financial Derivatives in Renewable Energy Companies”.

We are glad to present you this Second Edition of the “Observatory on the Case Law on Claims for Financial Derivatives in Renewable Energy Companies”. It demonstrates that since the Supreme Court issued its first two Judgments at the end of 2015, a significant change has occurred allowing more and more large companies or even professionals to obtain favourable judgments from Spanish Courts.
