£1.5m for motorcyclist seriously injured by van

Harvinder Kaur and Jill Greenfield acted for a young woman involved in a serious road traffic accident several years ago.

She had been riding her motorbike when she was struck by a van. She suffered several orthopaedic fractures and a head injury which were treated in hospital.

However, despite there being no organic reason and despite having at least two lengthy stays in rehabilitation units, she remained unable to walk independently when she came to Fieldfisher. She was largely wheelchair bound and lived alone and was dependent upon others for help to leave her home. She had not been able to work since her accident.

The woman had already obtained legal advice from several law firms and evidence had been obtained from experts in various fields. None of the experts had been able to explain her inability to walk independently.

Harvinder and Jill felt that the claimant had not received the correct type of rehabilitation for her needs and set about having her seen by specialists at The Wellington Hospital, who identified that she was suffering from a Functional Neurological Disorder. Following this diagnosis, the appropriate medical evidence was then obtained for the claim. 

The claimant clearly required a multi-disciplinary approach to her rehabilitation with a significant emphasis on psychology. Further interim funds were secured from the Defendant’s representatives and the treatment commenced. A case manager was also instructed who co-ordinated the Claimant’s rehabilitation. A team of support workers was brought in to assist the claimant with daily activities, meaning she was able to access the community and develop a routine.

The Claimant lacked the capacity to manage her claim and financial affairs. Harvinder and Jill therefore obtained the court’s permission to appoint a litigation friend to assist her.

The claim settled for almost £1.5m and an application has been made to appoint a deputy to manage the finances. This compensation means that she can continue with her rehabilitation programme and has the resources to help her to lead an independent life once more.
