Settlement from Kingston General Hospital for bowel damage and PTSD

Jonathan Zimmern recovered £21,500 for Alexis who suffered an injury to her bowel and subsequent post traumatic stress disorder following keyhole surgery.

Alexis underwent keyhole surgery to remove her gallbladder at Kingston General Hospital in September 2007.

During the procedure her bowel was damaged and she was readmitted, requiring a second operation.

Sadly, the treatment Alexis received when she returned to hospital fell below an acceptable standard.  She was left unattended and in great pain throughout the night, largely ignored by the junior doctors on the ward.

The following morning she was finally seen by a consultant who recognised the urgency of her situation and she was rushed back to theatre.

As a result of the sub-standard care that Alexis received, she developed Post Traumatic Stress Disorder (PTSD).

In the words of the psychiatrist who gave evidence in support of her claim, her deteriorating symptoms and the lack of attention she received during the night led to a "sense of doom" that caused the PTSD.

Although her physical injuries healed, her psychiatric conditions persisted, affecting her career.

Jonathan Zimmern pursued a claim for medical negligence against Kingston General Hospital.

Following negotiations with the defendant hospital, Alexis accepted an offer of £21,500 plus costs. The case was taken on a no win, no fee basis.

After the case Alexis said:

"Fieldfisher recently helped me settle a claim for clinical negligence.

I fought hard on my own to get answers from the hospital where I received negligent treatment before I considered legal action. It was difficult and devastating and I didn't get very far.

I was near giving up when I contacted the clinical negligence team at Fieldfisher. From the first instance, everyone I spoke to was kind and compassionate.

Unfortunately, this was not always the case at other firms I contacted. Everyone at Fieldfisher made me feel as though I had someone fighting on my behalf. It was incredibly reassuring.

My solicitor, Jonathan Zimmern, has been fantastic. He was easy to contact,  personable  and incredibly thorough.

Although my claim was of relatively low value, I never felt as if Jonathan cared any less about my claim than I did. I know that because the claim was so emotionally distressing for me, I wasn't always the easiest client to deal with, but throughout the process Jonathan was nothing but incredibly patient with me."

He continued to say:

"I cannot recommend Fieldfisher highly enough to anyone who is considering legal action."
