Long road to recovery for cyclist suffering severe back injury
Jenny met 55-year-old Philip Cavell, a passionate cyclist and co-founder of Cyclefit, at the London Bike Show. Philip suffered severe spinal injury in a fall after hitting a pothole on his bike and was in constant pain, with lack of function that seriously affected his work and personal life.
When Jenny met him, he had already undergone spinal surgery that actually made him worse, leaving him dependent on taking maximum pain relief to relieve his constant agony. An MRI scan eventually showed there was no fusion at T12-L2 in his spine.
Philip was unhappy with his current law firm and instructed Jenny to take over the case. Since Philip's case was approaching the 3-year limitation, Jenny acted fast and secured a pre-action admission of liability. Upon issuing, however, the loss adjusters applied to withdraw that admission, meaning Jenny had to pursue a High Court hearing, which she won.
The outcome is that she secured Philip the funds for a second spinal surgery privately in May 2017, which lasted six hours and involved removing metal inserted in his spine during initial surgery. It also pays for rehabilitation, aids and equipment and to adapt his house to his needs.
Post-surgery and following almost six years battling with spinal problems, Philip is now blogging about the hard work involved in his physio and rehabilitation, his determination to give 110 percent to succeed and the difficulties faced by his family following the accident and their support during his long recovery.
Following settlement, Philip said: 'You bring an extra dimension to your work that I think is priceless and simply incomparable.'
