Amputee claim: £2m+ for motorcyclist hit head-on by HGV

In May, Trevor, an avid motorcyclist, was returning from a family trip when a HGV travelling in the opposite lane lost control and collided head on with Trevor's stationery motorcycle. Trevor suffered serious injuries to his legs, pelvis, head and left shoulder.

Consequently he was airlifted to Queen's Medical Centre in Nottingham where he was treated by the major trauma team. Despite the best efforts of the tireless medical staff at Queen's Medical Centre, Trevor's right leg could sadly not be saved and he underwent a trans-femoral amputation in June.

Like many road traffic accident victims, Trevor was initially referred to a panel firm of solicitors who represented him for the next three years. Despite receiving an admission of liability the panel firm were unable to bring Trevor's claim to a resolution and, during the three years that had elapsed, secured him only £155,000 in interim payments whilst incurring costs in excess of this amount. An application to secure funding for specialist accommodation also failed, leaving Trevor living in unsuitable multi-storey accommodation throughout the conduct of the litigation.

Trevor instructed Mark Bowman  after reading of Mark's successes in amputee claims in the Limbless Association newsletter. Within weeks of being instructed we were able to secure Trevor an interim payment of £200,000. In addition, new experts were instructed to prepare reports in order that Trevor's case could be accurately valued.

The Defendants agreed to hold a settlement meeting in Trevor's claim so that the already lengthy litigation could potentially be ended. Within just 4 months of being instructed a final award of £2,125,000 was agreed much to the delight Trevor and his wife.

Trevor's compensation ensures he has sufficient funds to purchase specialist accommodation, state of the art prosthetic limbs in the form of an Ottobock Genium and Genium X3, and suitable aids and appliances for the remainder of his life. Though no amount of money will ever truly compensate Trevor for the immeasurable trauma he has suffered, Mark and the personal injury team at Fieldfisher are glad to have made a difference that will allow Trevor to look to the future.

At the end of the case, Trevor commented:

"Elaine and I want to thank Mark and the team at Fieldfisher for the help we have received since May. We took the difficult decision to change representation at a late stage, after some increasingly worrying setbacks with our initial solicitors. We were pleasantly surprised how different Feildfisher's approach was to ourselves and the process. Also, how quickly Mark pulled everything together and improved our situation, despite the sheer volume and varying quality of documentation generated in the previous years.

Previously we were treated as a part of a process, rather than people trying to cope with a set of difficult circumstances. At all times Fieldfisher ensured we were kept informed of what was happening in such a way that we felt the team cared about our situation. The relief we felt when the case was settled is difficult to describe. Finally after over 3 years  we will finally be able to get on with our lives.

Thank you."
